The court also issued arrest warrants for two top aides of the Libyan leader, his son Saif al-Islam and intelligence chief Abdullah al-Sanussi.
The warrant was requested by the ICC chief prosecutor Luis Moreno-Ocampo in May. He said there was evidence that Gaddafi "personally ordered attacks against Libyan citizens unarmed and was behind the arrest and torture of political opponents."
Libyan officials have said previously that they do not recognize the court and were not concerned with the possible issuance of arrest warrants.

Libyan Rebels say Gaddafi was killed
Officials of the National Transitional Council (CNT) today announced that the deposed leader Colonel Muammar Gaddafi of Libya was killed on Thursday during a raid on his hometown of Sirte.
Gaddafi was on the run since August, when rebels entered the capital Tripoli and his regime ended 42 years - the longest in Africa, and one of the longest in the Middle East.

Political group declares autonomy in eastern Libya
Civic leaders in eastern Libya have declared semi-autonomy for their oil-rich region at a meeting in Benghazi.
They say the move is necessary as the region, once known as Cyrenaica, has been neglected for decades.
But the move has caused tension with the governing National Transitional Council (NTC) in the capital Tripoli.
Thousands of major tribal leaders and militia commanders attended a celebratory ceremony in the region’s center of Benghazi on Tuesday.
The congress stated that Cyrenaica had suffered decades of marginalization under the ouster ruler Muammar Gaddafi. Now the oil-rich region extending from the coastal city of Sirte to Egyptian border is taking its fortunes into its own hands.
The congress appointed Ahmed al-Zubair Ahmed, who was a political prisoner under Gaddafi and currently is a member of NTC, as leader of its governing council. Despite being a part of the Libya’s official ruling body, Al-Zubair pledged to protect the rights of the eastern region.
They promised to end decades of marginalisation under Gaddafi and named a council to run the affairs of the newly created region, Cyrenaica, extending from the central coastal city of Sirte to the Egyptian border in the east.
Al Jazeera’s Nicole Johnston, reporting from the capital, Tripoli, said the announcement in Benghazi was only the beginning of a process.
“It is certainly significant, but we need to put it into context : first of all, they have announced the formation of a new regional council, and this will actually take a couple weeks to form," it said.
"At this stage, they say they would like independence, but they have not declared independence. At this stage they haven’t even declared a degree of semi autonomy."
The declaration underscored the weakness of the NTC, which has been largely unable to establish its authority around the country since the fall of Gaddafi in August and his death in October.
In fact, the NTC holds little sway even in Tripoli, where militias that arose during the anti-Gaddafi revolt have divided districts into fiefdoms.
Al-Senussi said he was elected by 4,000 to 5,000 tribal leaders, politicians, activists and academics who met Tuesday in Benghazi. "All of them agreed on my leadership to lead the region for the time being," he said.
Al-Senussi added that he had no interest in grabbing the oil wealth for the region's residents at the expense of the rest of the country. "The oil is for all Libyan people," he said. "It would be written into the constitution."
He added that his first priority would be to stabilize the region. "Security is a priority now," he said.
Al-Senussi said he had no immediate plan to resign from the National Transitional Council. "I was thinking of resigning, but I got advice from some people that I should take some time to see the reactions of the NTC first."
